John Robertson: Scrap “Tangata Whenua” — It’s Spiritual Garbage in Legal Disguise


Let’s stop pretending: tangata whenua has no place in modern law. It’s a spiritual phrase, built on myth, used to justify race-based privilege. And it needs to go — now.

The term means “people of the land,” but it's really code for “special rights through ancestry.” That’s not law — that’s theology. It turns public policy into tribal religion. It hands out legal perks based on who your ancestors slept with. That’s insane.

Here’s the truth: every human on Earth is mixed. There are no purebloods, no sacred bloodlines, no chosen people. Interbreeding has been going on for hundreds of thousands of years. You don’t get legal power because of your grandad’s grandad. You don’t get to veto decisions because someone told you your DNA is more spiritual than mine. That’s not equality — that’s legal voodoo.

New Zealand law has been infected with this nonsense. Tangata whenua appears in legislation, local council plans, education, resource management, and even courtrooms. Why? Because our lawmakers are spineless. Too afraid to call it what it is: apartheid wrapped in cultural language.

This isn’t about Māori culture. This is about spiritual authority being written into law — where it does not belong. Want to practice your culture? Fine. Want to embed mystical terms like mana, wairua, mauri, and tapu into binding legislation? No. Not in a secular country. Not in a democracy.

We don’t put Christian prayers in laws anymore. We don’t use Islamic fatwas to decide zoning rights. So why the hell are we letting animist spirituality dictate land use, education, and government consultation?

The term tangata whenua has become a sacred cow in New Zealand — untouchable, unchallengeable, irrational. But here’s the brutal truth: it’s a legal con. A way to elevate one group above all others, using race and mysticism as the excuse. That’s not inclusion. That’s a caste system.

If we really believe in equality, then it’s time to burn this rubbish to the ground. No one gets special treatment. No one gets legal superiority. No more tribal vetoes. No more race-based consultation. No more sacred terminology baked into policy.

- Because we were born here.

- Because we live here.

- Because we pay taxes here.

- And because we’re all the same species — not two tribes living in parallel universes.

You want real unity? Then start by deleting this divisive, spiritualised garbage from the lawbooks. - Start with tangata whenua.

When is logical thinking going to apply to our politicians? You are 100% right John. I reject being referred to as a “visitor” in my own country.

It is a con. Maori are not the tangata whenua. Maori knew full well that there were others here before them. That is why, the now sacred, Te Tiriti describes them as "tangata maori." David Rankin, of Ngapuhi affiliation, also confirms Maori were not the first people of this land.
