KiwiRail directors have a track record with infrastructure – but what about safety?

Just over a year ago, announcing new appointments to the KiwiRail board, Rail Minister Winston Peters said they brought commercial, freight and rail experience and a ‘can do’ attitude.

But when it comes to safety issues, can they do it as urgently as recent incidents demand?

Last year, Cabinet papers promised that New Zealand’s agricultural-product regulator would be required to use assessments from trusted overseas regulators. The Bills now before Parliament instead say the regulator must merely “have regard to” them.

A duty to have regard to something is not a duty to use it. It can be satisfied by reading the overseas assessment, noting it, and then doing the local assessment much as before.

One aspect of that is fear and accompanying that is a desire to stay safe – from criticism, condemnation. Better to do nothing than do something and be criticised for it.

In this article I look at the issue of safety and the word “safe” and how that word has been weaponised.

Let me begin with a word. Not a law, not a regulation, not even a policy — just a word.

“Safe.”
