The subsequent behaviour of Green MP Tamatha Paul, and Te Pāti Māori MP Rawiri Waititi, is racist and disgraceful.

Sandra Goudie: Waitangi Tribunal – time to go!

The Waitangi Tribunal must change or be removed following the cessation of historical Treaty settlements by 1992 as stated in the Treaty of Waitangi Act.

Why?

Queen Victoria spread her cloak over all the peoples of New Zealand in both the Royal Charter of 1840 and the signing of the Treaty of Waitangi.

Queen Victoria made it clear that all citizens were equal in the law.

The Treaty does not need to be re-visited and nor is there any need for Treaty Principles.

What the government needs to do is honour the Treaty by ensuring we are all treated equally in the law.

That means wherever there is reference to the Treaty of Waitangi in law, the wording must be changed to reflect fact. Ergo, we must ‘have regard to the Treaty of Waitangi’ and not the words, ‘have regard to the Principles of the Treaty of Waitangi’ since none have been established. All legislation/regulation should be amended accordingly.

What Treaty Principles? There are none.

The Attorney General responded to my request for a copy of the Principles of the Treaty of Waitangi by saying that there is no ‘authoritative copy’ of the Treaty Principles, but he said they have been ‘explored and discussed’ by the courts and the Waitangi Tribunal. (Letter available from the Attorney General’s office – just write and ask him for it.)

Exploration and discussion does not a principle make.

Sandra Goudie: Giveaway Votes

Giveaway votes – in 2020 the ‘giveaway vote’ was 7.9% of the total ‘party vote’ cast.

That 7.9% party vote came from the 12 minor parties who were unsuccessful, but still managed to garner 225,182 party votes between them. The smallest was HeartlandNZ with 914 votes.

What happened to those 7.9% party votes? They were apportioned on a pro rata basis to the successful parties. This meant Labour scored an extra 5 seats from the party votes cast for all the minor parties. National scored an extra 3 seats from those same party votes cast.

People don’t seem to understand that even in protest, party voting for a minor party which is clearly not going to win a seat and get anyone into parliament, just means giving your party vote away.

Sandra Goudie: Complaint to the Chief Ombudsman

To the Chief Ombudsman: Complaint regarding the Attorney General and the Minister for the Environment.

An OIA request asking for a copy of the Principles of the Treaty of Waitangi has been rejected by both of the above entities.

The same person has dual roles in regard to being both the Attorney General and the Minister.

The inability to provide the information has huge justice issues for the people of New Zealand being subject to law which embodies phrases requiring that ‘must give effect to the Principles of the Treaty of Waitangi.’

Sandra Goudie: Subsidiary Companies

Recently I sat in on a select committee for 3 Waters concerning the Water Services Economic Efficiency and Consumer Protection Bill.

Forget it folks.  One glaring example - the Chair of the select committee didn’t appear to know anything about subsidiary companies. Even in spite of the fact that it is in large part stepped out in the Bill.

Sandra Goudie: Further submission on the Natural & Built Environment Bill

The premise of new environmental legislation is to improve on the workability of the RMA to deliver better outcomes for people and communities while at the same time protecting the environment.

The case for that premise is well proven.

 Hard working mums and dads have spent thousands of dollars and time on minor works, as well as funded by way of rates the millions of dollars and time it takes for Councils to get anything done through the RMA process.

Sandra Goudie: More Shonky Legislation?

Right now we have 24 days to make submissions to the Therapeutics Products Bill.

On the basis of protecting us all from harmful product, the Bill will have one person appointed by the Minister as a Regulator. A public servant subject to Ministerial oversight.

That one person is supposed to “foster and maintain an independent and effective system to regulate”.

Medicines, medical devices, API’s (active pharmaceutical ingredients), and biotech products are all subject to the Regulator's oversight.

However, for no discernable reason, NHP’s (Natural Health Products) have been included.

Sandra Goudie: Rural Property Lockdown

Already Regional Councils require farm plans to some degree, activities became discretionary for any property identified as being a “significant natural area” (SNA), and fencing is becoming increasingly compulsory, and at least in one case a discretionary activity.

Practically any remnant of bush can be classified as an SNA on the basis of maintaining a corridor. People have had their lives turned upside down as they battle to understand what is happening while at the same time trying to defend their love of the land and ethic of stewardship.
