As per usual, Muriel is all over this, the Supreme Court ruling is a Trojan Horse for tikanga and the coalition must press ahead with the legislation, in fact strengthen it to cut out tikanga in NZ Law.

Tikanga is not and cannot ever be law. The same way Matauranga cannot ever be science.

It is 'a way of understanding' that fluctuates in interpretation within contextualised social (tribal) interactions.

It maybe comparable to common sense in any particular social 'situation'.

It needs to be cut from all law, legislation, judgement and precedent purely because it has no fixed point upon which the determination can be hinged......

Indeed, Anna. And, if the alarm bells aren't already ringing, Gary Judd' KC's comments to Sean Plunket today, should absolutely underscore that this is no time to back away from the much needed legislation to address this issue. Given the gross imbalance of the resources directed at Maori today (relative to what they contribute), if they had an ounce of good faith they would concede that the foreshore and seabed is for the benefit of everyone. And to those that claim that they didn't cede sovereignty - why should we be giving this issue even a moment's thought?
